The Senate this afternoon voted to rebuke the president=E2=80=99s border =
emergency declaration. C-SPAN
The Senate today rebuked President Trump's push for declaring a national =
emergency on the U.S.-Mexico border, a move that could affect plans for =
building a barrier near environmentally sensitive areas.

The Senate voted 59-41 for a resolution disapproving of the president's =
recent emergency declaration that would allow him to spend billions of =
dollars on constructing a wall without congressional approval.

Twelve Republicans and all of the chamber's Democrats and two =
independents voted to adopt it. It marked one of the few times the =
GOP-controlled Senate has bucked the White House on a top priority.

With the House having already passed the resolution, the measure now =
heads to the president's desk, where Trump is expected to issue his =
first veto.

Congress is unlikely to have the votes to override it, although ongoing =
court actions could indefinitely delay any order from Trump.

The White House believes the emergency order would supersede a recently =
passed spending bill that limits building in five historical and =
environmentally sensitive border areas in Texas, including the National =
Butterfly Center.

The North American Butterfly Association has ongoing federal litigation =
against the administration that would halt construction near the center =

The North American Butterfly Association is heading to a federal appeals =
court to fight President Trump's border wall, which would cut through =
the group's South Texas butterfly refuge.

The group filed a notice of appeal yesterday to the U.S. Court of =
Appeals for the District of Columbia Circuit, setting up a challenge to =
a recent lower court defeat.

The butterfly group runs a 100-acre refuge in Mission, Texas, on the =
border with Mexico. The site is in the path of a 33-mile route of new =
levee barriers funded by Congress in last year's omnibus spending bill =
and would be severed by the construction.

The group says the Department of Homeland Security's plans to build the =
barriers violates both the National Environmental Policy Act and the =
Endangered Species Act.

The U.S. District Court for the District of Columbia rejected the claims =
last month, ruling that DHS was authorized under the Illegal Immigration =
Reform and Immigrant Responsibility Act of 1996 to waive environmental =
